Terms of use

Effective date: April 10, 2026

This is a legal agreement (“Agreement”) between you and Mountain Equipment Company (“MEC”). This Agreement applies to your interactions with MEC, including purchases of products or services, membership, collection or use of any rewards or benefits, or use of the mec.ca site and any subdomains.

This Agreement includes MEC’s collection, use, and disclosure of personal information as set out in our Privacy Notice.

By interacting with MEC or maintaining an MEC membership, you agree to this Agreement. If you do not accept the terms of this Agreement, please do not continue interacting with MEC. If you are a member and you do not accept the terms of this Agreement, you must also close your membership by contacting Customer Care.

Membership, Rewards, and Discount Programs

Membership Terms

A member is any individual who has registered for MEC membership (which includes individuals that signed up for membership, a MEC user account, or MEC Member Rewards). These Membership Terms apply to all MEC members.

MEC membership is available for free to individuals who are 16 years of age or older. You may only have one active membership at a time. You cannot transfer your membership to another person, or let someone else use it. You are responsible for keeping your Membership information accurate and up to date.

You may register for a user account on the Site in connection with your membership. The rules governing your user account are set out in the “Use of the Site” section below.

MEC may refuse, merge, or close your membership at any time and for any reason, including if:

  • Your membership is inactive for a period of time (for example, if you have not made a purchase in more than seven years).
  • You have multiple memberships.
  • You have violated this Agreement, including by engaging in fraudulent activity, product resale, inappropriate conduct, or violation of any laws. If MEC closes your membership for one of these reasons, you may not register for another membership with MEC.

You may close your membership at any time by contacting Customer Care.

MEC Member Rewards Terms

MEC Member Rewards are benefits that MEC offers to all MEC members. These Rewards Terms govern your collection or use of any membership rewards or benefits you receive from MEC. MEC may change membership benefits at any time and for any reason.

Member Rewards Levels

For current reward levels, see MEC Member Rewards. Your reward level is determined by your annual spending with MEC:

  • We calculate your spending on a calendar year basis.
  • Only product purchases count towards your spending. Any other purchases or amounts (including gift cards, taxes, shipping, services, and rentals), do not count towards your spending.
  • Returns and cancellations count against your spending threshold. If you make a return or cancellation, it may result in a level downgrade. Once you reach a new spending threshold, you will be upgraded to the corresponding level. Once you reach a level, you will retain the level for the rest of that year and the entirety of the year after.

At the conclusion of each calendar year, MEC will review your purchase history, rewards level, and date you achieved that level to determine whether you will maintain your current level or will be adjusted to a different level for the following year.

It may take us a couple of days to change your level in our systems after you reach a spending threshold.

Member Benefits

As a member, you may receive various benefits (including rewards, member pricing, coupons, offers, access to events, and discounts) based on your membership, location, engagement, email marketing subscription status, or rewards level. For a general outline of current benefits, see MEC Member Rewards.

There is no cash value for benefits. You can only use or redeem benefits in accordance with the specific terms associated with such benefits.

Certain benefits are only available to members who have consented to receive marketing emails from MEC. You can sign up for marketing emails here.

Benefits may be subject to availability and may be added, modified, or removed at MEC's sole discretion. You cannot transfer your benefits to another person.

Expiration & Forfeiture of Benefits

Benefits, including rewards, coupons, discounts, and offers, may expire after a specified period, which may vary depending on the type of benefit. Please refer to the specific terms of each benefit for detailed expiry information. Rewards associated with membership levels will expire 12 months from the date you earn them, unless we say otherwise.

Modifications & Termination

MEC reserves the right to modify or terminate membership benefits (including member levels) at any time and without prior notice. If the benefits or levels are terminated, any unused benefits will be forfeited and will not be redeemable.

If your membership is closed for any reason, you will forfeit any unused benefits, including level rewards.

Communications

As an MEC member, we may send you communications related to your membership.

To receive marketing emails related to your membership, including rewards, discounts, and access to events, you will need to consent to receiving marketing communications from MEC. You can sign up for marketing emails here.

You may opt out of marketing communications at any time by following the unsubscribe instructions in those communications. If you opt out of marketing communications, you may not receive all the benefits associated with your membership.

Benefit Disputes

All decisions made by MEC regarding membership benefits, including eligibility, rewards, and access to events, are final and binding.

Discount Programs

MEC may offer discount programs for specific groups of members, at its sole discretion. We may discontinue or alter any discount program at any time.

Terms of sale

All product sales from MEC are governed by this Agreement, our Rocksolid Guarantee, the Returns Policy, and any other terms specific to the purchase (collectively, the “Terms of Sale”).

By purchasing, ordering, or accepting delivery of products from MEC, you agree to be bound by these Terms of Sale, which are subject to change without notice at MEC’s sole discretion.

All Sales

When you make a purchase from MEC, you agree that:

  • All sizes and weights quoted are approximate.
  • All prices listed are in Canadian dollars and all charges will be processed in Canadian dollars. All prices listed are subject to confirmation.
  • We may limit the quantity of items that you may buy, at our sole discretion.
  • Any quoted amounts for sales tax are estimates and subject to the appropriate tax rates of the applicable province or territory at the time of purchase.
  • No product may be purchased for re-sale.
  • You may use a maximum of three payment methods (excluding gift cards) for any one transaction. You may not split transactions. See the WARRANTIES AND DISCLAMER and LIMITATION OF LIABILITY, INDEMNITY, AND RELEASE sections below for additional information.

Orders for Pick-up or Delivery

When you make an order for store pick-up or for delivery, you agree that:

  • You will pay all charges payable for your order.
  • We may cancel orders at our sole discretion.
  • Product listings on the Site are an invitation for you to make an offer to purchase. Your order is an offer, which we may accept or decline, including due to pricing errors or availability.
  • When multiple products are purchased, the products may ship in multiple deliveries. Multiple charges may be made to your payment method corresponding to different products. If multiple charges are made, the order total quoted at checkout may differ from the amounts charged due to rounding.
  • We will use commercially reasonable efforts to deliver items as quickly as possible, and within any time indicated. However, we are not responsible for delivery delays beyond our control. We will endeavour to notify users if delivery is delayed. All items are delivered by a third party, and delivery is governed by their shipping contracts.
  • We reserve the right not to ship to certain addresses or post office boxes, including freight forwarders.

Yard Sale

Yard Sale products can be used, damaged, or otherwise show signs of wear and tear. When you purchase a Yard Sale product from MEC, you agree that:

  • You may not return the Yard Sale product. The Rocksolid Guarantee does not apply.
  • The Yard Sale product is sold “as is, where is” and MEC does not make any warranties related to this product.
  • You release and discharge MEC from any claims or damages resulting from use of the Yard Sale product. The WARRANTIES AND DISCLAMER and LIMITATION OF LIABILITY, INDEMNITY, AND RELEASE sections of this Agreement apply to Yard Sale products.

Gift Cards

Your purchase or use of an MEC Gift Card (including e-Gift Card or Gift Card purchased from a third party), is subject to MEC’s Gift Card Terms and Conditions and any terms set out on or with the Gift Card. A maximum of three gift cards can be used for any transaction.

Returns and Warranty

Product returns at MEC are governed by our Rocksolid Guarantee and Returns Policy.

Other than as set out in the Rocksolid Guarantee, MEC expressly disclaims all warranties associated with products sold by MEC. See the WARRANTIES AND DISCLAIMER section of this Agreement.

Use of the Site

By accessing or using the mec.ca site and any subdomains (the “Site”), you accept the terms of this Agreement.

In return, you may use the Site solely for personal reasons and as set out below. You may not use the Site to provide services to any third party.

Member user account

Members can create an online user account on the Site. By creating or maintaining a user account, you agree that:

  • All information you provide in connection with your account will be correct, accurate and complete.
  • You are solely responsible for maintaining the secrecy and security of your account password.
  • Your account is for your personal use only. You may not authorize others to use your account or transfer your account to any other person.
  • MEC is not responsible for another party’s access to your account which results from misappropriation of your log-in details.
  • You will notify MEC promptly of any unauthorized access or use of your account.
  • You are solely responsible for all uses of your account and any activity performed through it.
  • You will ensure that you exit from your user account using the proper sign-out procedures at the end of each session.
  • You will use caution when accessing your user account from a public or shared computer so that others are not able to view or record your password and other personal information. MEC has the right to disable your user account or password at any time in our sole discretion.

Acceptable Use

You may only use the Site if you are 16 or older.

When using the Site, making a Submission (as defined below), or otherwise interacting with MEC, you must not:

  • Engage in or promote any illegal activity or violate any applicable law.
  • Harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party.
  • Do anything that is defamatory, libelous, tortious, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, discriminative, invasive of another’s privacy, false, misleading, or otherwise objectionable.
  • Post, upload, submit, or otherwise provide personal information that identifies an individual other than you, including any personal information that could identify a minor.
  • Impersonate or attempt to impersonate MEC or any MEC employee, another member, user, or entity.
  • Engage in any conduct that may harm MEC, our members, users, or customers, or that might expose us or others to liability.
  • Make commercial use of the Site (including making purchases for resale) unless you are otherwise authorized under contractual obligations with MEC.
  • Reproduce, publish, modify, distribute, transfer, and/or sell any Content (defined in the “Intellectual property and ownership” section below).
  • Infringe any patent, trademark, trade secret, copyright or other intellectual property rights of any person, including MEC.
  • Use tools or other methods (whether automatic or manual) to extract, mine or gather data from the Site, without MEC’s written consent.
  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site.
  • Introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.
  • Attempt to penetrate security measures of the Site or obtain or bypass other users’ passwords.
  • Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.
  • Attack the Site via a denial-of-service attack or distributed denial-of-service attack.
  • If you violate any of the above, MEC may terminate your membership, your user account, or your permission to access and use the Site. We may also take other steps as deemed necessary by us.

Use of Artificial Intelligence

MEC may use or offer Artificial Intelligence (“AI”) tools for you to use, on our Site or otherwise.

If MEC offers an AI tool for you to use (such as a Site chatbot), we will clearly let you know that you are interacting with AI. Responses or answers generated by AI tools may not always be correct, and you should not rely on any answers you receive from an AI tool.

You must follow the Acceptable Use standards set out in this Agreement when you are using an AI tool offered by MEC.

Links to third party websites or events

Where the Site contains a link to an external website, event, or resource:

  • You are responsible for ensuring you verify the URL and are aware when you go to a third-party site.
  • You should read the third-party website privacy notice and terms of use and make an informed decision about whether you want to use the website or their services, events, or resources.
  • You are solely responsible for and assume all risk associated with your use of any such website, event, or resource. You agree that MEC is not responsible or liable for the availability or accuracy of such third-party websites or resources, or the events, content, products, or services on or from such websites or resources.

A link to an external website, event, or resource does not imply any endorsement, approval, association or sponsorship by MEC.

Linking to our Site

You may link to our Site, provided:

  • You do so in a way that is fair and legal and does not damage or adversely affect MEC’s reputation.
  • You do not suggest any form of association, approval or endorsement by MEC where none exists.
  • You do not establish a link from any website that is not owned by you.
  • Our Site must not be framed on any other site. We reserve the right to withdraw linking permission without notice, in our sole discretion.

Submissions

You are responsible for any information, opinions, comments, photos, feedback, ideas, product reviews, chat messages, prompts, or any other content you submit, upload or post to our Site (each, a “Submission”). By making a Submission, you agree that:

  • You will comply with the Acceptable Use requirements set out in this Agreement.
  • You are solely responsible for the legality, accuracy, reliability, and appropriateness of your Submission.
  • MEC does not review Submissions for compliance with applicable laws, including intellectual property laws.
  • Except for communications with Customer Care, Submissions may be viewed, shared, or commented on by others.
  • You grant MEC a perpetual, irrevocable, fully paid up, sublicensable, assignable, worldwide licence to use, reproduce, distribute, and disclose your Submission for any purpose, including operational purposes.
  • You represent and warrant that you own or control all rights necessary to grant the licence above.
  • You agree to any additional terms applicable to specific features or services (such as Product Reviews or Ask & Answer), which may be governed by third-party platforms. Any feedback or suggestions you provide are voluntary, and MEC may use or disregard them at its discretion. Submissions reflect the views of the individual submitting them and do not represent MEC’s views. MEC is not responsible or liable for the content or accuracy of any Submission. MEC may, at its sole discretion:
  • Remove or refuse to post any Submission.
  • If a Submission violates this Agreement, take any action it considers appropriate, including disclosing user information where required or permitted by applicable law.
  • Suspend or terminate your access to all or part of the Site, including your membership or user account.

You release and hold harmless MEC from any claims arising from actions taken in connection with Submissions or related investigations.

MEC does not pre screen Submissions and does not guarantee their prompt removal. MEC assumes no responsibility or liability for Submissions or for any action or inaction relating to such Submissions.

System integrity

When using the Site, data may be transmitted over networks in which MEC cannot guarantee secure or reliable data transmission. As such, we assume no responsibility for the delay, failure, interruption or corruption of any data or other information transmitted in connection with the Site.

The Site may be unavailable from time to time due to maintenance or other factors within or beyond MEC’s control. MEC is not liable for any resulting interruption in access or use of the Site.

Protection of privacy and security

By using the Site or maintaining an MEC membership, you agree to MEC’s collection, use, and disclosure of your personal information as set out in our Privacy Notice.

Protection of your Personal Information is a top priority for us. As such, we will maintain administrative, physical, and technical safeguards at a level no less protective than those described in our Privacy Notice.

To maintain the privacy and security of the Site, you must not disclose any security or privacy vulnerabilities that you may discover about the Site to any person except MEC.

Immediately upon discovering any issues that may be pose a threat to the privacy and security of the Site or data stored within the Site, you must notify us at [email protected].

Communications

In accordance with Canada’s Anti-Spam Legislation (CASL), we require your express or implied consent to send you commercial electronic messages.

At any time, you can opt out of digital marketing communications from us by clicking on the unsubscribe link at the bottom of our emails, adjusting your communication preferences within your user account, or contacting Customer Care.

Even if you have opted out, we may still contact you in relation to your MEC membership, purchases, product safety updates, and other reasons permitted by law.

Intellectual property and ownership

All content available through MEC’s Site or stores, including text, images, software, audio visual materials, data, trademarks, logos, and other proprietary materials (collectively, “Content”), is owned by MEC or its partners and vendors. Content does not include Submissions. Content is protected by Canadian and international intellectual property laws. “MEC,” “Mountain Equipment Company,” the MEC logo, and related names and marks are trademarks of MEC.

You may view Content solely for personal, non commercial use. Images, audio, and video must not be altered and must be used in accordance with Canada’s Copyright Act (R.S.C., 1985, c. C 42). Any other use requires MEC’s prior written consent.

Unauthorized use of Content is prohibited. Your membership or participation in any MEC program does not grant any rights in the Content. No rights are transferred under this Agreement. You are solely responsible for any Content you use or share.

All rights not expressly granted are reserved by MEC. Any unauthorized use may breach this Agreement and applicable law.

WARRANTIES AND DISCLAIMER

THE SITE (INCLUDING ANY CONTENT, LINKS, AND SUBMISSIONS) AND ANY PRODUCTS OR SERVICES PROVIDED BY MEC ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH NO WARRANTY OF ANY KIND, EXCEPT AS OTHERWISE SET OUT IN THIS AGREEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, GUARANTEES, REPRESENTATIONS, AND CONDITIONS WITH RESPECT TO THE SITE AND ANY PRODUCTS OR SERVICES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS REGARDING ACCURACY, CURRENCY, AVAILABILITY, TIMELINESS, COMPLETENESS, UNINTERUPTED OR ERROR-FREE OPERATION, SECURITY, LEGALITY, MERCHANTABILITY, DURABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, FREEDOM FROM ERRORS, OMISSIONS, COMPUTER VIRUSES, OR OTHER MALICIOUS OR UNAUTHORIZED CODE OR PROGRAMS, AND IMPLIED WARRANTIES OR CONDITIONS ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. IN ADDITION, MEC DOES NOT REPRESENT THAT ANY PARTICULAR PRODUCTS OR INVENTORY WILL BE AVAILABLE AT ANY PARTICULAR STORE.

MEC DOES NOT REPRESENT OR WARRANT THAT THE SITE IS SECURE, ACCURATE, COMPLETE, OR CURRENT. SITE MAY CONTAIN ERRORS, INACCURACIES, OR OMISSIONS. INFORMATION ON THE SITE IS FOR CONVENIENCE AND INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED TO CONVEY ADVICE OR RECOMMENDATIONS. MEC RESERVES THE RIGHT TO CORRECT ANY ERRORS, INACCURACIES, OR OMISSIONS, OR TO CHANGE OR UPDATE INFORMATION AT ANY TIME WITHOUT PRIOR NOTICE, INCLUDING AFTER AN ORDER HAS BEEN SUBMITTED. PLEASE NOTE THAT SUCH ERRORS, INACCURACIES, OR OMISSIONS MAY RELATE TO PRICING AND AVAILABILITY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, MEC RESERVES THE RIGHT TO CANCEL OR REFUSE TO ACCEPT ANY ORDER PLACED BASED ON INCORRECT PRICING OR AVAILABILITY INFORMATION. IF AN ITEM BECOMES UNAVAILABLE FOR WHATEVER REASON AFTER AN ORDER IS ACCEPTED, MEC MAY TERMINATE THE ORDER BY GIVING YOU WRITTEN NOTICE. IN SUCH EVENT, MEC WILL CONTACT YOU TO ARRANGE FOR A REFUND.

YOUR USE OF THE SITE IS AT YOUR OWN RISK. MEC will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your use of the Site. You also agree that MEC has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content or communications maintained by the Site. No advice or information, whether oral or written, obtained from MEC or through the Site will create any warranty not expressly made herein.

LIMITATION OF LIABILITY, INDEMNITY, AND RELEASE

TO THE MAXIUMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MAXIMUM LIABILITY OF MEC, ITS SUBSIDIARIES, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS (THE “MEC PARTIES”), RELATED TO ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION PERSONAL INJURY OR DEATH, LOSS OF PROFITS, DATA, USE, GOOD WILL, OR OTHER INTANGIBLE LOSSES (“DAMAGES”), RESULTING FROM OR RELATING TO YOUR SHOPPING, ORDERS, PURCHASES, RETURNS, AND SERVICES OBTAINED FROM MEC IS LIMITED TO THE AMOUNT YOU PAID TO MEC FOR THE PRODUCT(S) OR SERVICES RELATED TO THE CLAIM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MEC PARTIES WILL NOT BE RESPONSIBLE FOR DAMAGES RESULTING FROM OR RELATING TO: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR SUBMISSION OF ANY THIRD PARTY ON THE SITE, INCLUDING WITHOUT LIMITATION ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATIONS OF YOUR TRANSMISSIONS OR SUBMISSIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

THESE LIMITATIONS ON LIABILIY APPLY REGARDLESS OF WHETHER THE INDEMNIFIED PARTY, HAD REASON TO KNOW OR KNEW OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH IN THIS AGREEMENT IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.

YOU AGREE AT ALL TIMES TO INDEMNIFY, DEFEND AND HOLD MEC AND OUR AFFILIATES AND SUBSIDIARIES, LICENSORS, SUPPLIERS AND SERVICE PROVIDERS, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SHAREHOLDERS, DISTRIBUTORS AND REPRESENTATIVES HARMLESS FROM ANY ACTION, PROCEEDING, LIABILITY, LOSS, CLAIM AND EXPENSE, INCLUDING REASONABLE LEGAL AND OTHER FEES AND DISBURSEMENTS, SUSTAINED, INCURRED OR PAID DIRECTLY OR INDIRECTLY BY MEC AS A RESULT OF (I) YOUR VIOLATION OF THIS AGREEMENT; (II) YOUR USE OF THE SITE OR THAT OF ANY OTHER PERSON WHO ACCESSES THE SITE USING YOUR USER ACCOUNT; OR (III) YOUR SUBMISSIONS. YOU ALSO AGREE TO RELEASE AND HOLD HARMLESS MEC FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, DAMAGES, ACTIONS, AND COSTS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, REVIEW OR REPRODUCTION OF THE SITE.

Miscellaneous terms

Severability and waiver

Some of the exclusions or limits in this Agreement may not apply in certain jurisdictions in Canada under applicable laws, including consumer protection laws. Nothing in this Agreement limits or excludes any liability or legal right that cannot be limited or excluded by law. If any part of this Agreement is found to be invalid or unenforceable, the rest of the Agreement will continue in effect to the extent permitted by law.

If MEC does not enforce a right or provision of this Agreement, it is not a waiver. A waiver must be given by MEC in writing and applies only to the specific situation for which it is given.

Unless expressly stated otherwise, the rights and remedies in this Agreement are in addition to, and not a replacement for, any other rights or remedies available at law or in equity.

Governing law

This Agreement is exclusively governed by and will be construed in accordance with the laws of the Province of British Columbia, and any federal laws of Canada that may be applicable in British Columbia. The Courts of British Columbia have exclusive jurisdiction over this Agreement.

The International Sale of Goods Act of British Columbia and the United Nations Convention on Contracts for the International Sale of Goods will not apply in any way to this Agreement or to the transactions contemplated by this Agreement.

Entire agreement

This Agreement constitutes the entire and only agreement between us and you, and supersedes any prior agreements, representations, warranties and understandings with respect to your Membership, the Site, the Content or services provided by the Site, the products and services provided by MEC, and the subject matter of this Agreement.

Enurement

All covenants, representations, warranties and agreements contained in the Agreement will be binding upon and will enure to the benefit of both MEC and you and any respective successors, permitted assigns, legal representatives, heirs and trustees.

Language

This Agreement is written in English and French. If there is a conflict or inconsistency between the English and French versions, the English version will take priority and govern.

Contacting MEC
